McMahan’s Case Against Nationwide
McMahan represented Desi Crosby in a bad faith insurance claim against insurance giant Nationwide. After experiencing a devastating accident where a farm vehicle hit his automobile, Crosby was left with over $200,000 in medical expenses. Crosby suffered injuries to his hip, arm and knee. At the time, Crosby was working as a forklift operator, but was unable to return to work after the accident.
The owner and operator of the farm vehicle admitted fault, but Crosby was paid only half of his medical expenses from the farm owner’s auto insurance. Nationwide, the insurer of the farm, refused to pay any settlement to Crosby even though the farm vehicle was being used in a business capacity at the time.
McMahan successfully prosecuted Crosby’s claim, which resulted in Nationwide paying Crosby a settlement of $650,000 for his injuries and lost wages.
